Hmmm.. I think at this point the image belogns to the graphic artist...

How does someone own an image of French or Russian art
of the 1900's or even let's say some one older like
Van Gogh and assume he has no decendents if I buy a
poster and have a graphic artists make a replica the
image is now mine isn't it???

they don't allow pictures in museums, among other reasons, because your
pictures is your property. image owners control access to the image, and then
sell
copies of the image to which they control access.
Approach this problem another way... find out who holds the image, and then
ask for a license to replicate it... just pay a royalty...
